Damaged Product: If you have a damaged product we need to be notified at the time of delivery, email us at care@azwood.co.nz or free call 0800 299663 Provide us with the invoice number that the products were supplied on. We will work out to find a solution to this. A credit may be issued. You may or may not not need to return the faulty product to us for assessment at Azwood's discretion. In the event of damaged or problem product, all product must be retained and not on-sold while the issues is being investigated as photographs are often requested. All freight carriers require product to be available for collection when a claim is being sorted.

Title: The title and property do not pass in either the goods or proceeds from the sale or otherwise of the goods to a third party until paid in full.
Conditions: When the material is to be delivered in places other than on paved or metaled streets, the customer is to provide roadways or approaches permitting access of trucks to point of delivery under their own power. The seller reserves the right to stop deliveries in the event that such roadways are not provided. If the customer orders deliveries beyond the curbing, the customer assumes all liability for damage to curbs, footpaths, driveways, or other property, and shall be liable for all costs incurred in removing the truck from the site.
It is the responsibility of the customer to provide the correct delivery address. If the delivery is unable to be completed by Azwood due to the fault of the customer, the customer will be charged the full delivery fee. If the truck gets stuck the customer will be charged for removing the truck from the site. If Azwood arrives on site and finds the delivery site is not suitable and Azwood cannot unload the product the customer will be charged a failed delivery fee at a minimum rate of $160+gst per hour.
The customer agrees that the customer is responsible for the costs of any damage that was not caused by the Azwood delivery truck. All delivered pricing is based on suitable access and site conditions for HPMV truck & trailer units.
Disclaimer of Liability: As media and landscaping products, including composts are made from batch to batch, strict control cannot be exercised over all the conditions including some fertiliser response, weather, plant & property management. Before during & after any use. No responsibility will be excepted by Azwood under any circumstances to any failure in performance, loss, damage, or injury whether direct or indirect or consequential arising from storage handling, mixing, or use of these products, and the purchaser shall bear sole responsibility for the correct selection, use and application of this product and acknowledge that the purchaser is buying this product in reliance on the purchaser’s skill or judgment and not that of Azwood.
In the event of a failed delivery (when a delivery vehicle arrives at the site and can’t unload) due to unsuitable delivery areas or conditions, Azwood reserves the right to charge the customer for the time and distance of travel. This is calculated at $160.00 +GST per hour.

Visitors: All visitors to any site operated by Azwood must report to the site office for induction to onsite hazards. A safety hat, high visibility vest, and appropriate clothing must be worn when around machinery. All visitors must be accompanied by a member of the staff at all times. This must be by prior appointment to all manufacturing sites.

Delivery Guarantee: We aim to have your delivery to you on time & in full.
In the rare occurrence of a truck breaking down or running late, we will contact you to inform you of the situation and put a plan in place. We aim with all our business operations and valuable customers to treat you, fair, just & with the highest respect.
Booking ahead for timely delivery is advisable, however, we accept “same-day delivery’s in the Nelson Region” and will work together to slot in a suitable time.
Quotations: All written quotations are valid for the number of days the quotation states, otherwise, it’s 30 days from the date quoted.
All currency displayed on this website is in $nzd.
Payments on account or invoice: You agree to pay for all products & services that your order upon Azwood completing your order, and receiving the invoice. You agree that any collection debt cost that occurred will be met by yourself.
Cancellations: If you place an order and then cancel when the order has already been dispatched, we will issue a refund minus a $160+gst per hour failed deliver fee.
Hours: Unless otherwise agreed between parties, we will supply the Goods and/or perform the Services during normal working hours. Any cost attributable to us being required by the customer to work outside these hours shall be payable by the customer

Delivery: The delivery truck sizes are governed by the load size, load type, and dispatch sequences. You must ensure that you have sufficient access for the vehicle before placing an order.
Your chosen ideal drop-off area should be a flat and even surface near the area you want to lay the product.
Deliveries are made using large vehicles and it is the customer’s responsibility to inform the company if there may be an access problem.
Where we are to deliver the Goods, the Customer must:
(a) Ensure we have all-weather encumbrance-free access to the site, to enable us to deliver the Goods safely;
(b) Obtain all necessary resources and other consents from the relevant local authority and inform us of all matters relating to such consents;
(c) Locate, mark and advise us of all gas pipes, water pipes, sewerage lines, septic tanks, drainage lines, telephone cabling, and other utilities that are on, near, or adjacent to the delivery point, and of any actual or possible subsidence, slip, erosion, flooding or any other thing that might constitute a hazard on the land where Goods are to be delivered;
(d) The customer, or somebody appointed by the customer, must be at the delivery point to accept the delivery or the customer explained in detail and left a marker for where the product load is to be dumped.
If a certain method of delivery vehicle is required it is the customer’s responsibility to inform the company of these special requirements.
The company reserves the right to cancel or hold any orders that the company deems may suffer from potential delivery problems and the customer understands that delivery dates may be delayed in these instances.
The customer will clearly advise in writing the place where the goods are to be delivered and acknowledges that the site is accessible for delivery. There will be no liability whatsoever on the vendor or its subcontractors for any damage which may be caused in the course of delivery and unloading on site.
The company’s deliveries are generally gate-to-gate or curbside deliveries. The driver will attempt to deliver to the requested location whenever possible, but in the instance where the driver thinks this location is hazardous or inaccessible or likely to get stuck, then the nearest possible area to the requested position will be used, the customer also understands that the company can only guarantee a gate to gate or kerbside delivery and that ultimately the customer is happy for goods to be left kerbside.
The Customer shall pay all freight and cartage charges including any additional costs or expenses incurred by us (including charges for waiting time or delivery outside of normal business hours).
The company will not accept any liability for damages to property caused during delivery.
The customer indemnifies Us against any costs, claims, and damages incurred in the delivery of the Goods including any cleaning, repairing damage to the site or delivery equipment, and returning the delivery vehicle to the road, provided we have acted with reasonable care and skill.
The Customer must make any claims for short delivery within 48 hours of delivery of Goods by Us and must state the date of delivery of the Goods and the delivery docket number.
Late Deliveries: The company will make every effort to deliver products ordered on the agreed date, but, if for any reason the company is unable to deliver then no liability will fall to the company; whether in damages or otherwise, for delay of whole or any part of the goods ordered arising from any cause whatsoever.
We will take all reasonable care to ensure that our products & services are fit for the purpose for which they have been designed, but we are not responsible for factors and circumstances beyond our control.
If products are out of stock then the company also reserves the right to cancel or hold orders for reasons beyond our control.
Any products or service that you purchase is generated only at your request and solely on the basis of the information you provide to us. You agree that:
(a) Any information we provide to you is information only, and not advice.
(b) We are not responsible for checking the accuracy, relevance, or significance of any information you provide to us.
(c) You will ensure that the information you provide is complete, accurate, and up-to-date. If you are uncertain about what information to provide in response to our questions, you will seek appropriate advice from a third party of your choice.

Product Variances: Colour, texture, size, content, individual rocks, stones, barks, shells & soil types made be broken or misshaped variations may occur in Goods due to:
(a) The use of naturally occurring materials in the manufacturing process; and
(b) Normal manufacturing tolerances and processes.
Such variations do not constitute a product defect and we shall not be liable for any loss or damage suffered by you as a result of such variations.

Reservation of Title: That title and property does not pass in either the goods or proceeds from sale or otherwise of the goods to a third party until paid for in full. Upon any sale or other disposition of the goods for value prior to full payment for the goods.
In the event on non-payment, Azwood will reserve the right to change the costs of collection retrieving the product.
Azwood Ltd shall be legally and beneficially entitled to the proceeds and the debtor must pay such proceeds into a separate bank account and immediately thereafter account to Azwood Ltd for such proceeds.
Payment and Accounts: The debtor will pay Azwood for all goods and or services supplied, or any other monies due here under as per the terms set out below.
Unless otherwise stated, payment for Goods and Services must be made on or before 20th of the month following date of invoice.
Should Azwood not receive payment, all costs of the collections process will be payable by the customer. We reserve the right to charge a minimum of $10, or interest at the rate of 5%, whatever is greatest, on accounts overdue by 30 days until the date the goods are paid in full. In the event of court proceedings being issued for non-payment, all costs, including our legal fees, will be payable by the customer. We reserve the right to issue legal proceedings in any court.
Azwood reserves the right to withdraw credit facilities in its absolute discretion at any time, and payment shall thereafter be due on the delivery or purchase of any further products supplied.
Azwood reserves the right, at any given time, to apply Stop Credit to outstanding accounts, with or without notice.

Liability: The liability of Azwood Ltd for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the goods or any other breach of Azwood Ltd’s obligations hereunder, shall not exceed any amount equivalent to the price paid by the customer for the goods supplied. Azwood Ltd accepts no liability for any loss, damage of injury whatsoever unless it is notified as to claim within fourteen (14) days from the date upon which the risk in the goods would be deemed to pass to the customer pursuant to these conditions of supply.
Change of Details: The customer must notify Azwood Ltd of any change in any of the details provided by it on the Credit Account Application within 7 days of such change occurring.
Personal Guarantee of the Company Directors or Trustees: If the Customer is a company or trust, the director(s) or trustee(s) signing for the Customer, in consideration for Azwood Ltd agreeing to supply services and grant credit to the Customer, also signs in their personal capacity and jointly and severally personally guarantee and undertake to Azwood Ltd the payment of any and all other monies now or hereafter owed by the Customer to Azwood Ltd. Any personal guarantee made by any party shall not exclude the Customer in any way whatsoever from the liabilities and obligations contained in this contract.
The guarantors and Customer shall be jointly and severally liable under the terms and conditions of this contract.
The Company Directors and/or Trustees guarantee to make good any overdue monies owed by the company in the event of the company being placed in receivership, ceasing trading or being wound up. If any provision of this contract should be invalid or illegal or unenforceable the validity or existence legality and enforceability of the remaining provisions shall be not affected, prejudiced or impaired.
